Well-known Letterkenny solicitor guilty of misconduct

A WELL-KNOWN Letterkenny solicitor has been found guilty of misconduct and ordered to pay €15,000 to the Law Society of Ireland.

Sean McGlynn, formerly practising as Sean McGlynn & Company, Suite 41, Town Centre, Justice Walsh Road, Letterkenny, was before the Solicitors Disciplinary Tribunal on February 6, 2014.

The matter was reported in the latest issue of the ‘Gazette’, the society’s monthly publication.

It was stated that he was guilty of misconduct in his practice as a solicitor, in that he failed to comply with two undertakings, one given on January 20, 2004, and the second given on November 3, 2004, in respect of his named client.

On both occasions, McGlynn undertook that he: “Would ensure that the borrower had or would acquire a marketable title to the property free from encumbrances, save for the proposed charge in favour of Bank of Scotland Ireland, in a timely manner or at all.”

He also failed “in a timely manner or at all”  to reply to the society’s correspondence and, in particular, the society’s letters of July 16, 2010, August 6, 2010, August 30, 2010, September 15, 2010, September 30, 2010, December 14, 2010, January 6, 2011 and March 18, 2011.

In addition, McGlynn failed to attend at the meetings of the Complaints and Client Relations Committee on October 7, 2011, and November 25, 2011, despite being required to do so.

The tribunal ordered that the respondent solicitor: “Do stand censured; Pay a sum of €10,000 to the compensation fund and pay a sum not exceeding €5,000 as a contribution to the whole of the costs of the Law Society of Ireland.”
