A MAN is to stand trial in October charged with burglary and causing damage at a Letterkenny car dealership. Thomas McDonagh (45), 2 Canal Road, Letterkenny, was served the Book of Evidence at Monday’s Letterkenny District Court.
McDonagh is charged that on May 4, 2019 at Divers Garage, Canal Road, he allegedly damaged a motor vehicle belonging to Terence Diver. The offence is contrary to Section 2 (1) of the Criminal Damage Act 1991.
On the same date and at the same location, McDonagh is charged that he allegedly damaged a roller shutter door, caused damage to a steel gate and took possession of and used a mechanically propelled vehicle belonging to Terence Diver, contrary to Section 12 of the Road Traffic Act, 1961.
McDonagh is further charged that on the same date and at the same location, he allegedly entered a building as a trespasser and did commit an arrestable offence to wit unauthorised taking of a car belonging to Terence Diver. The offence is contrary to Section 12 (1) (b) and (3) of the Criminal Justice Theft and Fraud Offences Act 2001.
Sergeant Jim Collins told the court that the Director of Public Prosecutions (DPP) has consented to the accused being sent forward to the next sitting of Letterkenny Circuit Court, commencing on October 28, 2025.
Judge Éiteáin Cunningham administered the alibi warning. Solicitor Donna Ponsonby, acting on behalf of solicitor Patsy Gallagher, sought legal aid and one counsel.
McDonagh was remanded on bail on the same terms and conditions as previously set down by the court, including that he reside at an address provided to the court and that he is contactable 247 on his mobile to gardaí.
The court was told a number of outstanding court fines had been paid by McDonagh to the court earlier in proceedings.
The court was told some summary matters are to be added to the indictment. The matter was adjourned until October 13.
