A FATHER and daughter have been sent forward for trial charged with illegal dumping on lands in Rossbracken, Letterkenny.
Jim Ferry (63) and Louise Ferry (32), both of Slieve Sneacht Road, Letterkenny appeared before a sitting of the District Court this afternoon over the alleged dumping by their company Ferry’s Refuse Recycling Ltd.
Mr Ferry, who is facing 41 charges, is accused of disposing or treating waste in a manner that caused or was likely to cause environmental pollution on a date unknown between January 1, 2012 and March 31, 2012 and various dates between 2014 and 2016.
He is accused of not disposing of waste in accordance with the conditions of a waste permit on a date unknown between July 17, 2013 and September 30, 2013. He faces a charge of storing waste in excess of 250 tons on a date between November 10, 2016 and January 31, 2017.
Mr Ferry is also accused of failing to comply on February 8, 2017 with a notice issued under the Waste Management Act 1996 to prevent or limit environmental pollution dated January 12, 2017 requiring him to stop disposing, holding or recovering waste.
Louise Ferry, is accused of being director of Ferry’s Refuge Recycling Ltd and disposing of waste in a manner that could cause environmental pollution on a date unknown between December 16, 2014 and December 31, 2014. She is facing ten charges under the Waste Management Act.
Garda Matthew Burke gave evidence of serving the books of evidence on the pair at today’s sitting of the court.
The Director of Public Prosecutions consented for the two accused to be sent forward for trial to the next sitting of Letterkenny Circuit Court commencing on May 10, 2022.
Solicitor Ms Maureen Gallagher told Judge Brendan O’Reilly that she was acting as an agent in the case for J V Geary Solicitors, Castlebar and requested a senior counsel to be assigned.
The Judge applied the alibi warning and legal aid was granted to both defendants.
