A MAN has been sent forward for trial charged with the alleged sexual assault of two women at a nursing home in Donegal.
The accused appeared before Letterkenny District Court on Monday where he was served with the Book of Evidence.
The accused is charged with two alleged counts of sexual assault against two different people at the same nursing facility on different dates.
The first alleged sexual assault is alleged to have occurred at the facility between December 1 and December 31 in 2022. The second offence is alleged to have occurred between December 1 2022, and May 4, 2023, at the same facility.
Both charges are Contrary to Section 2 of the criminal Law and Rape Amendment Act 1990 as amended by Section 37 of the Sex Offenders Act. A publication order is in place preventing the accused from being named to protect the identities of the alleged victims.
Garda Pauline Doherty gave evidence of serving the Book of Evidence on the accused at Letterkenny courthouse in the presence of his solicitor Patsy Gallagher.
Garda Sergeant Jim Collins told the court that the Director of Public Prosecutions (DPP) has consented to the accused being sent forward for trial to the next sitting of Letterkenny Circuit Court on February 3.
Judge Emile Daly administered the alibi warning. The accused was remanded on bail on the same conditions as previously set down by the court.
Garda Sergeant Jim Collins told the court that the accused has already surrendered his passport.
Mr Gallagher sought one counsel at this time, adding that he would reserve a decision for a second counsel in the case.
