Man charged with violent rape in Letterkenny to stand trial

A MAN is to stand trial at the Central Criminal Court in Dublin charged with raping a young woman in Letterkenny last year.

The accused, who is aged in his 20s, appeared via videolink at Monday’s sitting of Letterkenny District Court.

He cannot be named for legal reasons due to the nature of the charges and in order to protect the identity of the alleged victim.

Detective Garda Lorna Doherty told the court that the Book of Evidence had been served on the solicitor of the accused, Mr Patsy Gallagher, earlier that morning.

Sergeant Jim Collins said that the Director of Public Prosecutions (DPP) had consented to the accused being sent forward to the current sitting of the Central Criminal Court in Dublin.

A translator relayed proceedings in the Arabic language to the defendant.

The accused faces four charges from the alleged incident off Lower Main Street on Sunday, October 20, 2024.

The accused is charged that he did intentionally or recklessly strangle a woman contrary to Section 3a (1) and 3(3) of the non fatal offences against the person act 1997 (as inserted by section 21 of the criminal justice (Miscellaneous Provisions ) Act 2023.

He is charged with rape contrary to section 4 of the criminal law rape amendment act 1990.

The accused is further charged with rape contrary to section 48 offences against the person act 1861 and section 2 of the criminal law rape act 1981, as amended by section 21 of the criminal law rape amendment act 1990.

He is further charged with assault contrary to Section 3 of the non fatal offences against the person act 1997.

Mr Gallagher requested two counsel for the trial.

Judge Ciaran Liddy issued the alibi warning to the accused and adjourned the case to the current sitting of the Central Criminal Court in Dublin.
