A MAN who stole Lego worth more than €1,100 from Smyth’s Toys in Letterkenny has avoided being jailed.
Derek Joyce (47), Brownscross Oldtown, Dublin, was before Letterkenny District Court on Monday.
Joyce is charged with the theft of Lego to the value of €1,125 from Smyth’s Toy Store in Letterkenny on June 6, 2023.
Sergeant Jim Collins told the court that when approached by gardaí in relation to the matter, Joyce was fully compliant.
Joyce has some previous convictions, the court heard.
Solicitor Mr Patsy Gallagher said the incident occurred over two and a half years ago when his client was under severe pressure regarding addiction.
“The Lego was for the birthday of a family member,” said Mr Gallagher.
“My client is now 18 months sober.”
Mr Gallagher told the court that his client has raised some of the €1,100.
Sergeant Collins pointed out that in some cases certain stores do not wish to take the money, but instead they might donate it to a charity.
Joyce has not come to garda attention since 2023, the court was told.
Judge Emile Daly praised the positive outlook outlined to the court, but said she also had to take into consideration Joyce’s previous convictions and the sizeable theft from Smyth’s.
On the basis that Joyce provides the €1,100 to gardaí to return to the outlet, Judge Daly imposed a two-month custodial sentence suspended for six months.
