MEMBERS of Donegal County Council have voted to take legal action against Cllr Frank McBrearty.
The monthly Council meeting has been adjourned for two weeks following another day of disruption and no business being done.
Cllr Frank McBrearty attended today’s (Monday) reconvened meeting in the Aura Leisure Centre despite getting a one month suspension at last Monday’s meeting.
Cllr McBrearty refused to leave the meeting and it was adjourned before 2pm until 3pm to allow councillors to discuss the next course of action.
The meeting was further adjourned until 3.30pm, and when councillors returned they voted on a motion authorising the Chief Executive to secure an injunction in the High Court.
Outlining the motion, Cathaoirleach Jack Murray said based on legal advice and in conjunction with the Chief Executive, he was putting forward a motion to commence proceedings in the High Court against Cllr McBrearty seeking all appropriate orders required to enforce the suspension, including an order for the cost of the proceedings.
The motion was carried and Cllr Murray said it was ‘low day’ for Donegal County Council.
“Things I have seen here today have been nothing short of appalling.
“It is a very very low day for Donegal County Council.
“Some of the things I have witnessed I never thought I would see in a democratically elected forum.
“It is a very low day for our council.
“I would say this, it was conducted and carried out by one person and one person alone.
“Everybody else in this room has handled themselves with dignity throughout the day and have been dragged into this position,” said Cllr Murray.
Gardaí were present during the recorded vote and waited for Cllr McBrearty to leave the meeting.
The meeting has now been adjourned until Monday February 22 at 11am.
