Letterkenny man told by judge to stay out of Derry City

Court

A LETTERKENNY man was today (Monday) ordered to stay out of Derry City apart from his court appearances as part of his bail conditions.

Brendan Boyle (49) of 96 Meadowbank appeared before Derry Magistrate’s Court charged with three assaults, criminal damage, disorderly behaviour, possessing an offensive weapon, namely a glass, and assaulting a civilian detention officer.
All of the offences are alleged to have occurred on November 28.

The court was told that police were called to an incident in the Bentley Bar in Derry City centre where staff had asked an intoxicated male, Boyle, to leave and he had refused.

It was alleged that he had assaulted several members of staff and that once he was outside the bar he had thrown a glass at a staff member which smashed against a door frame and showered a baby in a pram with glass.

A police officer told the court that once he was arrested Boyle was abusive to staff and banged on doors in the detention block.

She said that as he was being escorted back to his cell from the toilet he punched a civilian detention officer in the face.

The officer opposed bail stating that Boyle had 38 previous convictions some of them for similar offences at other establishments in the city.
She said he had shown no respect for the law.

A defence solicitor, Mr. Oliver Roche, asked had Boyle made the case that he had been assaulted by staff members and had lost a tooth and the officer said he had.
Boyle was released on bail on condition that he did not enter Derry except for court appearances, the next being December 18.
