Defendant’s non-appearance was due to kidney donation

A Milford man was unable to be in court because he was recuperating in hospital after he had donated a kidney to his daughter.

Brian Friel, who is 40 and from Gortmacall, Milford, pleaded guilty at Glenties District Court to driving with no insurance and no licence at Gortnamucklagh, Glenties on November 27 last year.

Sergeant Oliver Devaney told the court gardai spotted a Grey Lexus that drove towards and parked at Connell Close in Glenties.

The defendant did not produce his documents when apprehended.

The court was told he had 11 previous convictions, and all were for road traffic offences. He been banned from driving for five years in December 15 for having no insurance and given a four-year driving ban for a similar offence in 2014.

Defence solicitor Patsy Gallagher asked for the case to be put back to February to assess the possibility of a Community Service Order.

He said the defendant was not present, because he had donated a kidney to his daughter, bit had picked up a kidney infection and was on a respirator in hospital for four weeks.

The solicitor said he had notified the gardai.

He said he appreciated that his client was at risk, given the previous convictions, but it was a genuine case and was an unusual set of circumstances.

Judge Paul Kelly adjourned the case for the preparation of a Probation Report to see if the defendant was suitable for a Community Service Order.

But the judge added that this was no guarantee of the outcome of the case.
