A young Donegal boy has been awarded €10,000 after suffering a severe burn during an incident involving a gas heater.
The boy and his family were on holiday in France at a Eurocamp in Brittany on June 17, 2018 when the incident took place.
He was just under two years of age when he hit his arm off a hot gas heater in a cabin, Letterkenny Circuit Court heard this week.
Counsel for the plaintiff, Peter Nolan BL said the young boy suffered severe burns and was given first aid with cream applied to the wound
When he returned to Ireland, he was examined by the family doctor.
On July 15, 2019, the plaintiff was again examined and it was noted that he had a faint discolouration on his arm but the wound was healing well and he had full range of movement. There was no residual scar.
“He had recovered extremely well regarding the scarring,” said Mr Nolan.
In relation to the incident itself, he told Judge John Aylmer: “We say the heater was not properly screened.”
The plaintiffs were keen to have an engineer attend the court in that respect but when that was put to the other side, reality dawned.
Mr Nolan referred to a concern that liability could be apportioned to the parents with contributory negligence alleged.
On that basis, he believed it would be wise to accept the offer of €10,000.
Judge John Aylmer agreed and approved the offer, noting the boy’s recovery.
