AN 11 year old boy who caught his toe on a broken tile in a hotel swimming pool has been awarded €10,000 in general damages at Letterkenny Circuit Court.
The incident occurred at the Redcastle Hotel on August 13, 2020 when the boy was six.
The infant was taken to Dungannon Hospital in County Tyrone for treatment to a laceration to his toe as a result of the accident.
The court heard that he was left with a one centimetre scar on the toe of his left foot.
An orthopaedic surgeon had indicated that the boy had been limping for around five months after the incident.
Pyschiatrist, Dr Colin O’Donnell said that the boy had suffered from flashbacks and had become obsessed afterwards in avoiding swimming pools.
Representing the boy, Patricia McCallum, B.L. said the sum of €10,000 had been recommended in general damages and €135 in special damages.
In his ruling Judge John Aylmer said he was happy to approve both offers.
