Application against Cllr O’Donnell fails

A DISTRICT Court application to get Cllr John O’Donnell to change the date of a standing order paying compensation to a woman whose foot he drove over, failed today (Wednesday).

Solicitor for the Kilmacrennan councillor, Mr McElhinney described the application on behalf of Ms Petra Kucklick as an attempt to ‘ridicule’ his client.
Prior to the case being heard Mr McElhinney handed over a cheque for €200 in arrears payments owed to Ms Kucklick.

Counsel for Ms Kucklick, Ms Laura O’Reilly BL, said the previous court ordered the compensation payments to be made on every Friday but they were not reaching Ms Kucklick’s account until Monday.

‘The purpose of this application is to ridicule him,’ Mr McElhinney said. He added that his client’s salary was paid into the bank on a Friday and it would be difficult if his salary was not there to meet the standing order.

Judge Paul Kelly said he would not order any change in the standing order.
‘It is being paid. Strike out the application. I will allow costs for this application,’ Judge Kelly added.
